Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, and sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating in any way to the Services. Your sole remedy for dissatisfaction with these Services is to stop using these Services.

Although we attempt to ensure the integrity and accuracy of the Services, we make no guarantees whatsoever as to the correctness or accuracy of the Services. It is possible that the Services could include inaccuracies or errors, and that unauthorized additions, deletions, and alterations could be made to the Services by third parties. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password, whether your password is with our Services or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

User Data

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as the data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of data.

Intellectual Property & Copyright Information

The Services contain copyrighted material (all rights reserved). The Services’ original content, features, functionality, source code, databases, software, designs, audio video, text, photographs, and graphics in the services, trademarks, service marks, and logos are and will remain the exclusive property of Kate Elliott Healing and its licensors. Any unauthorized use of copyrighted material on the Services is prohibited by federal law. The information contained on the Services, as well as all of Kate Elliott Healing’s ideas, suggestions, techniques, methods, resources, documents, articles, publications, software, webinars, live and recorded videos, live and recorded audios, social media posts, e-mails, interviews, classes, courses, trainings, products, events, seminars, sessions, other materials, and any and all derivative materials are protected by patent law and international copyright and trademark laws. No part of the Services may be reproduced, duplicated, transmitted, recorded, or taught in any form or by any means without permission in writing from Kate Elliott Healing. No part of these Terms may be reproduced or transmitted in any form or by any means without permission in writing from Kate Elliott Healing.

Electronic Communications, Transactions and Signatures

By using our Services, you agree to receive communications from us electronically. Electronic communications may include, but are not limited to, texts, emails, notices, alerts, messages, cellular phones, landline telephones, or video conferences. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email, and on the Services satisfy any legal requirements that such communication be in writing.

You acknowledge and agree that transactions conducted through our Services may be electronic. Electronic transactions may include, but are not limited to, purchases, agreements, and other legal actions.

Your use of our Services constitutes your consent to use electronic signatures. Electronic signatures may be used for agreements, consents, authorizations, and other legal documents. You are responsible for maintaining the confidentiality of your account credentials, including any electronic signatures. Any electronic signature associated with your account is considered your electronic signature. We will retain records of electronic transactions and communications for a period required by applicable laws.

Users are encouraged to retain their own records of important transactions and communications. We implement reasonable security measures to ensure the integrity and confidentiality of electronic transactions and communications. Users are responsible for keeping their devices and access credentials secure.

Any communications via electronic means may not be secure and may be susceptible to interception by unauthorized individuals or disclosure by third-party platforms. Accordingly, you agree not to hold us, our staff, and Healing Remembered™ Staff Practitioners liable for any breaches or disclosures by third-party platforms or software that are beyond our control.

You have the right to opt-out of receiving electronic communications from us. To do so, please contact Kate Elliott Healing at hello@kateelliotthealing.com. Opting out may impact your ability to use certain features or receive important notifications.

Third Party Transactions

Our Services may contain links to third-party websites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services. You acknowledge that any reliance on representations and warranties provided by any third party vendor shall be at your own risk. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage, loss, or cost caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, and sponsors make no warranties or representations whatsoever regarding any product or service provided or offered by any third party vendor.

We allow you to purchase products and services directly from third party vendors through links on the Services. By using the Services, you acknowledge and agree that Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, and sponsors shall have no liability for any cost, damage, or harm arising directly or indirectly from any third party vendor products or services ordered through the Services and any action or inaction of any third party vendor.

Advertisers

We may post the advertisements of third parties on the Services. Your correspondence or dealings with advertisers found on the Services are solely between you and such advertiser. Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, and sponsors shall not be responsible for any loss or damage of any sort incurred as a result of any such dealings or as the result of the presence of such advertisers on the Services, and shall not be responsible or liable for the statements or conduct of any third party on the Services including but not limited to advertisers.

Testimonials Disclaimer

We cannot assure specific outcomes, and testimonials shared do not imply a warranty or prediction for individual results using the Services for any particular issue. They are not meant to represent or guarantee that everyone will achieve similar results. Refunds

Full or partial payment of payment plans, subscriptions, sessions, programs, certifications, tuition, courses, offers, downloadable products, 7 Days of Quantum Healing™ weeks, or partial subscription periods are non-refundable, non-transferable, and cannot be rescheduled.

Live Events

Full or partial payment for payment plans, sessions, programs, certifications, tuition, courses, offers, downloadable products, 7 Days of Quantum Healing™ weeks, or partial subscription periods are non-refundable and non-transferable.

By your participation in events, offers, sessions, courses, trainings, or webinars you agree not to attempt to hold Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, and sponsors liable for any decisions, behaviors, actions or results that you make or experience in your business or in your personal life due to your participation in any of our events, offers, sessions, courses, trainings, or webinars at any time, under any circumstance.

Healing Remembered ™ App Use Policy

Healing Remembered™ app ("App") users (including former Easy Entity Release app users grandfathered into the Easy Entity Release and Offensive Energy sections of the App) that are not certified are expressly prohibited from using the app on friends and family, providing tutorials or demonstrations using the App, and charging any fees or receiving compensation in any form for providing sessions using the App or using the App in conjunction with any other methods, offers, services, or courses. By accessing or using the App, non-certified users agree to abide by this prohibition. We reserve the right to monitor user activities within the app to ensure compliance with this prohibition. Violations of this prohibition may result in the immediate suspension or termination of the user's account and access to the App.

The App and any information provided through it is not intended to constitute, replace, or be a substitute for medical care and is not intended to be used as a medical device, medical advice, for diagnosis, or for treatment. 

You are strongly advised to consult with qualified healthcare professionals or providers for accurate and personalized medical advice tailored to your specific circumstances. Never disregard professional medical advice or delay seeking it because of information obtained through the App.

If health concerns or physical symptoms are present, it is recommended you seek advice from a medical professional, as the information within the App is not meant to replace medical evaluation and treatment, nor are we giving medical advice or treatment. The App is also not intended for emergency situations. In case of a medical emergency, you should immediately contact emergency services or seek appropriate medical attention.

The App, its owners, officers, employees, interns, independent contractors, developers, operators, affiliates, and sponsors should not be relied upon as medical, psychological, or other professional advice of any kind or nature and disclaim any responsibility for actions taken by users based on information provided within the App. Reliance on the App's content is at the user's own risk.

We grant you a revocable, non-exclusive, non-transferable, limited license to use the App for personal use. Commercial use is only permitted to users who have met all of the requirements of the Healing Remembered™ certification. This license is conditional upon your compliance with these Terms.

You may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App. You may not sublicense, lease, rent, loan, or distribute the App to any third party. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices. 

We retain all rights, title, and interest in and to the App, including all intellectual property rights. The App is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. In the event of a third party claim that the App, or your possession and use of the App, infringes third party's intellectual property rights, we will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

We may provide updates or upgrades to the App to enhance functionality, security, or performance. You agree to promptly install any updates or upgrades provided by us. 

We are not responsible for any applicable third-party agreement between you and any third-party, including your wireless provider. You agree to comply with any applicable third party terms when using the App. 

You represent and warrant that: 
(a) You are not located in a country that is subject to a United States Government embargo, or that is on Title 15, Part 740 Supplement 1 Country Group E of the United States Code of Federal Regulations;
(b) You are not located in a country that has been designated by the United States Government as a "terrorist supporting" country; and 
(c) You are not listed on any U.S. Government list of prohibited or restricted parties. You further agree not to transport the Mobile App to or use the Mobile App in any such country.

This license is effective until terminated by you or us. We may terminate the license at any time without notice if you fail to comply with the terms and conditions.

The App is provided “as is” and “as available” without any warranties. We disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not represent or warrant that the App and your device are compatible or that the App will work on your device. 

In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the App.

Healing Remembered™ App Subscription

We offer certain premium versions, features and/or functionality of the App ("Paid Subscriptions") for a fee. By signing up for and using the App, you agree to our Terms and any additional terms and conditions provided here. The Paid Subscriptions provide you access to certain enhanced sections, features, and functionality. By signing up for and using the Paid Subscriptions, including signing up for Free Trials of the Paid Subscriptions, you agree to pay any fees or other incurred charges that apply to the Paid Subscriptions (such as subscription fees).

When you sign up for the Paid Subscriptions, you must designate and provide information about your preferred payment method ("Payment Method"). This information must be complete and accurate, and you are responsible for keeping it up to date. You expressly authorize us to collect the appropriate fees charged for the Paid Subscriptions and for any other purchases you elect to make via the Services using your Payment Method.

Unless otherwise stated, all fees due for the Paid Subscriptions are payable in advance, and will be billed automatically to the Payment Method at the start of the monthly or annual Paid Subscription period, as applicable. Unless otherwise stated, Paid Subscriptions will auto-renew until you elect to cancel your access to Paid Subscriptions. All purchases of Paid Subscriptions are final and non-refundable, except at our sole discretion and in accordance with the rules governing each Paid Subscription.

You can manage your Paid Subscription, cancel it, or turn off automatic renewals through your Apple App Store account or through your account on our website (depending on where you set up your subscription) at any time. If you choose to cancel your Paid Subscription, it will remain active until the end of your current subscription period. Please note that uninstalling the App will not cancel your Paid Subscription. Once you have cancelled your Paid Subscription and received confirmation, no other changes can be made to your account. The cancellation of a Paid Subscription will go into effect at the end of your current billing cycle, and you will have the same level of access to the Paid Subscription through the remainder of such billing cycle. 

If you do not pay the fees or charges due for your use of the Paid Subscriptions, we may make reasonable efforts to notify you and resolve the issue; however, we reserve the right to disable or terminate your access to the Paid Subscriptions (and may do so without notice). We reserve the right to cancel a user's app subscription under certain conditions. These conditions may include, but are not limited to, a violation of the terms of service, misuse of the app, or any other behavior deemed unacceptable by us.

To the maximum extent permitted by applicable laws, we may change our prices for Paid Subscriptions at any time. We will give you reasonable notice of any such pricing changes by posting the new prices on or through the applicable Paid Subscription and/or by sending you an email notification. If you do not wish to pay the new prices, you can cancel the applicable Paid Subscription prior to the change going into effect.

Payment Plan Policy

Our payment plans include a specified number of installments, with due dates and amounts clearly outlined during the enrollment process. By enrolling in a payment plan with us, you authorize us to automatically charge the specified payment method for each installment on the scheduled due dates, and you agree to the non-refundable nature of the payments.

Late payments may result in consequences, including but not limited to suspension of services, termination of the agreement, and additional fees. We reserve the right to pursue legal remedies to recover outstanding amounts.

Requests for modification of the payment plan, including changes to installment amounts or due dates, must be submitted in writing and are subject to approval by us.

We reserve the right to modify these terms, with changes being effective immediately upon publication. The payment plans may be canceled or terminated by us at our discretion due to non-compliance with the terms or for other reasons deemed appropriate.

Certification Tuition Disclaimer

Tuition fees including payment plans for our courses and certifications are non-refundable and non-transferable. Payment of the tuition fee does not guarantee you will be certified, as we reserve the right to certify or to refuse certification to any applicant for any reason.

Healing Remembered™ Certification Policy

The Healing Remembered™ Certification (“HR Certification”) has a duration of six months from the date of enrollment. Enrollment is confirmed upon successful payment in full or upon payment of a down payment toward the course fees HR Certification enrollment and payment obligations are non-transferable to other individuals. An active Healing Remembered app subscription is required for the duration of the course and to have access to the course material.

If participants wish to become certified, they must fulfill their practicum requirements within six months from the HR Certification commencement date. Failure to complete the certification requirements within the six-month timeframe may result in additional fees, or loss of certification and Healing Remembered App Pro Level access. Successful completion of the HR Certification, including going through all of the material and meeting the practicum requirements, will result in the issuance of a certification of completion. 

Upon successful enrollment and completion of the HR Certification, as long as the Services’ terms and conditions are adhered to and an active Healing Remembered subscription is maintained, students are granted lifetime access to the course materials. Lifetime access is granted for the duration of the availability of the course materials on the hosting website. Lifetime access is granted solely for the purpose of the enrolled student's personal use. We reserve the right to revoke lifetime access at any time. Sharing access credentials or course materials with unauthorized individuals is strictly prohibited.

Quantum Healer Certification Policy

The Quantum Healer Certification (“QH Certification”) has a duration of six months from the date of enrollment. Enrollment is confirmed upon successful payment in full or upon payment of a down payment toward the course fees. QH Certification enrollment and payment obligations are non-transferable to other individuals.

Participation in the QH Certification Telegram group is available for the duration of the certification process, with the option ceasing either upon successful completion of the QH Certification or the expiration of the six-month timeframe, whichever occurs earlier. It is the participant's responsibility to track the expiration date of their Telegram group access. We are not responsible for notifying participants when their Telegram group access has expired.

If participants wish to become certified, they must fulfill their practice week requirements within a four-month window from the QH Certification commencement date. We will assign participants a designated practice week, and they have a period of seven days from the date of assignment to notify us if they are unavailable for that chosen week. Following the expiration of this seven-day period, no further changes to the assigned week shall be permitted. Failure to complete the practice week requirements within the four-month timeframe may result in additional fees or loss of practice week privileges and certification. Successful completion of the QH Certification, including going through all of the material and meeting the practice week requirements, will result in the issuance of a certification of completion. 

Upon successful enrollment and completion of the QH Certification, as long as the Services’ terms and conditions are adhered to, students are granted lifetime access to the course materials. Lifetime access is granted for the duration of the availability of the course materials on the hosting website. Lifetime access includes ongoing availability of course content, updates, and additional resources added after the initial completion. Lifetime access is granted solely for the purpose of the enrolled student's personal use. We reserve the right to revoke lifetime access at any time. Sharing access credentials or course materials with unauthorized individuals is strictly prohibited.

The three credits for 7 Days of Quantum Healing™ weeks that are included in the QH Certification will expire six months from the QH Certification commencement date. Participants are advised to utilize these credits within the stipulated timeframe, and any unused credits will be forfeited after the expiration period and are not transferable. The expiration policy is non-negotiable and applies to all participants who have signed up for the QH Certification. It is the participant's responsibility to track the expiration date of their credits. We are not responsible for notifying participants when their credits have expired.

Earnings and Income Disclaimer

We strive to accurately represent our products and services, providing income estimates for certified practitioners. However, we cannot guarantee that individuals will achieve the stated earnings, and users acknowledge the inherent risk that actual results may vary. Your success as a certified practitioner is contingent upon factors such as your individual capacity, business experience, expertise, desire, and market conditions, and there is no assurance of specific levels of success. Testimonials and examples on the Services depict exceptional results, not typical outcomes, and are not indicative of guaranteed results for every user. Each individual's success depends on various personal factors. Past earnings examples do not guarantee future results, and we cannot assure future success. Users must be aware of unknown risks in business and on the internet that could impact results, and we hold no responsibility for user actions.

Staff Practitioner & Kate Elliott Healing Sessions Disclaimer and Policy

Kate Elliott and Healing Remembered™ Staff Practitioners use the methods developed by Kate Elliott, M. Ed, CBCP in their sessions. These methods, which can be used in person or remotely, are not a substitute for medical care. The information shared in these sessions is not intended as medical advice and should not be used for medical diagnosis or treatment. This information is offered as a service and should not be considered a replacement for consultation with a healthcare provider, nor is it meant to replace any medical treatments as ordered by any physicians nor any other medical care you have been advised to seek by them.

You understand and acknowledge that any suggestions, guidance, or recommendations provided by Kate Elliott, her staff, and Healing Remembered™ Staff Practitioners concerning devices, products, services, or supplementation, including, but not limited to, vitamins, minerals, herbal preparations, compounds, or any other external or internal remedy, are expressly intended for informational purposes only. The utilization or ingestion of such remedies is undertaken at your own risk. Prior to making any changes to your health regimen, including the use or ingestion of suggested remedies, you acknowledge the importance of seeking the advice and consultation of a qualified medical professional. You understand that decisions related to your health should be made in consultation with a healthcare professional, and you assume full responsibility for any consequences resulting from such decisions.

We make no claims as to healing or recovery from any illness. These methods are not a replacement for any professional psychotherapeutic or counseling sessions in the treatment of any mental health issues or disorders. No guarantee is made towards validity. Information given to you on these Services or in any session obtained through this website or via any form of communication is not intended to create any physician-patient relationship, nor should it be considered a replacement for consultation with a healthcare professional. If you have questions or concerns about your health, please contact your healthcare provider.

Staff Practitioner sessions are paid for at the time of booking, and are non-refundable and non-transferable. If you need to reschedule, 24 hours’ advance notice for schedule changes are required, else the full session fee will apply. Sessions purchased will be valid for six weeks after the date of purchase, after which time they will expire. If you fail to appear without giving your Practitioner at least 24 hours’ notice, you forfeit the session. These sessions are for adults only. You represent that you are 18 years of age or older. The Practitioner may terminate services without a refund if they have reason to believe you are a minor.

Sessions booked with Kate Elliott are non-refundable, non-transferrable, and cannot be rescheduled. Emergency sessions will not include session notes.    

Termination

We may terminate or suspend access to our Services and your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation, if you breach the Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services.

All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is deemed invalid or unenforceable under applicable law, such provision will be deemed modified to the extent necessary to make it valid and enforceable, and the remaining provisions will remain in full force and effect.

These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have between us regarding the Services.

These Terms shall be governed by and construed in accordance with the laws of the United States, and to the extent applicable, the laws of the state of Florida without regard to its conflict of law principles. Any legal action, suit, or proceeding against Kate Elliott Healing must be brought in the Consolidated Municipality of Pinellas County, in the State of Florida.

By continuing to explore these Services, you represent you have read, understand, and agree to all of the above.
