This Informed Consent constitutes a legally binding agreement between you, Kate Elliott Healing, and Kate Elliott for healing sessions you are purchasing. By agreeing to this Informed Consent, you are consenting to receive services from Kate Elliott (“Practitioner”) under all of the terms and conditions outlined below.

Service Limitations

You understand when using Energy Medicine, the Practitioner is not “diagnosing” or “treating” the physical body, which is the domain of the medical field and other allied health care professionals. The Practitioner will use Healing Remembered™ during your session may use an alternative and complementary method of healing designed to alleviate imbalances and release trapped emotional energy, fostering harmony and equilibrium within while improving physical and emotional well-being.

Your participation in healing sessions with the Practitioner does not create a physician-patient or therapist-patient relationship. You understand there is a distinction between “healing” using Energy Medicine and the practice of medicine or any other licensed health care practice. Healing Remembered™ and Energy Medicine are not intended, and should not be used, to diagnose, treat, prevent, or cure any medical problem or psychological disorder. 

Additionally, you understand that this modality and Energy Medicine are not a substitute for medical, psychological, or therapeutic advice from a licensed physical health or mental health professional. You understand and acknowledge that any suggestions, guidance, or recommendations provided by the Practitioner concerning devices, products, services, or supplementation, including, but not limited to, vitamins, minerals, herbal preparations, compounds, or any other external or internal remedy, are expressly intended for informational purposes only. The utilization or ingestion of such remedies is undertaken at your own risk. Prior to making any changes to your health regimen, including the use or ingestion of suggested remedies, you acknowledge the importance of seeking the advice and consultation of a qualified medical professional. 

You understand that decisions related to your health should be made in consultation with a healthcare professional, and you assume full responsibility for any consequences resulting from such decisions. 

You understand and acknowledge that the Practitioner’s statements and opinions are theirs alone and any information provided to you is for informational purposes only. You are solely responsible for consulting with a licensed physician or mental health professional should you require physical or mental health care, or should you desire to use, or stop using, any prescription medication. You also agree that you will not hold the Practitioner or Kate Elliott Healing liable for any harm that may result from your failure to consult with a licensed physician or mental health professional, or your failure to follow such professional’s advice.

Kate Elliott Healing and the Practitioner do not make any promises or guarantees regarding the validity of Healing Remembered™, Energy Medicine, or your ability to experience healing or recover from any illness or issue. We cannot assure specific outcomes or results, and any session testimonials shared do not imply a warranty or prediction for individual results. You agree that you will not hold Kate Elliott Healing or the Practitioner liable for your failure to experience any specific outcome or result.

Kate Elliott Healing and the Practitioner make no claims as to healing or recovery from any illness. These methods are not a replacement for any professional psychotherapeutic or counseling sessions in the treatment of any mental health issues or disorders. No guarantee is made towards validity.

Liability Waiver

You agree that you will not hold Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, sponsors, and the Practitioner liable for any injury, illness, damage, harm, or losses of any nature that may arise, either directly or indirectly, due to your purchase of or participation in healing sessions. You further agree to indemnify and defend Kate Elliott Healing, its owners, officers, employees, interns, independent contractors, affiliates, sponsors, and the Practitioner against any claims made by any individual other than yourself for damages resulting, either directly or indirectly, from your purchase or participation in healing sessions.

Your Responsibility

You acknowledge and accept that the responsibility for your physical and mental well-being rests solely with you, and that all decisions made in the course of your healing journey inherently involve a level of uncertainty. You willingly accept any potential risks associated with healing sessions, regardless of whether you are cognizant of any specific risks.The healing session may evoke the processing of unpleasant or negative feelings, potentially causing emotional discomfort. It is advised that you make appropriate preparations before participating in any healing session. Prior to any healing session, you will inform the Practitioner of any physical or mental health issue that may be affected by the healing process.

Healing Remembered™ is the exclusive and copyrighted property of Kate Elliott Healing. 

Session Policy

Sessions are non-refundable, non-transferrable, and cannot be rescheduled. If you wish to book a session for one of your children, you can do so without asking their permission as long as they are 13 years old or younger. If they are 14 years old or older, please obtain permission from them prior to scheduling their session, as the session may not be effective otherwise because they can choose to override the healing by using their free will.  

Electronic Communications

You agree to receive communication from Kate Elliott Healing and the Practitioner electronically. Electronic communications may include, but are not limited to, emails, notices, alerts, texts, messages, phone calls, or video conference. Electronic signatures may be used for agreements, consents, authorizations, and other legal documents. You are encouraged to retain your own records of important transactions and communications. You are responsible for keeping your devices secure and maintaining the confidentiality of your account credentials, including any electronic signatures. Any electronic signature associated with your account is considered your electronic signature. Kate Elliott Healing will retain records of electronic transactions and communications for a period required by applicable laws and will implement reasonable security measures to ensure the integrity and confidentiality of electronic transactions and communications. You understand that any communications via electronic means may not be secure and may be subject to interception by unwanted people or disclosure by third-party platforms. You will not hold Kate Elliott Healing or the Practitioner liable for any breach of third-party platforms or software, or for any disclosure by third-party platforms that is outside of our control.

Privacy and Confidentiality 

Kate Elliott Healing and the Practitioner will take reasonable measures to uphold the privacy and confidentiality of all information you provide during the purchase and scheduling process, as well as in healing sessions. 

You are responsible for ensuring a safe and private environment during any healing sessions. You acknowledge that the Practitioner has the discretion to terminate a session prematurely if there is a reasonable belief that you are not in a secure or private location.

There is no legally privileged relationship between you and Kate Elliott Healing or the Practitioner. Therefore, we may share your information or communications if we are required to comply with a subpoena or order from law enforcement, a government agency, or a court of competent jurisdiction; or we are reasonably suspicious of your imminent danger or potential harm to yourself or others, or that you are engaged in child abuse, elder abuse, or human trafficking.

Social Media 

You understand that the Practitioner has a social media presence. Should you choose to make a “friend” or similar connection with the Practitioner on any social media platform, you understand that your identity or contact details may be revealed through the settings that various social media platforms use to share posts and connect people. You will not hold the Practitioner liable for any violations of your privacy that may occur through social media. You are solely responsible for your own social media activity and the privacy settings associated with your own social media accounts.

Liquidated Damages

You consent that, within the limits permitted by law, in the event of your success in any action against Kate Elliott Healing and/or the Practitioner for damages, notwithstanding the liability waivers outlined herein, your exclusive remedy for such damages is a reimbursement of any sum(s) paid for the healing sessions. This refund shall be deemed as liquidated damages.

Dispute Procedure

In the event of any real or perceived dispute arising from your purchase of, or involvement in, any healing sessions, you and the Practitioner mutually agree to attempt to resolve the dispute though a personal conversation. If this does not resolve the dispute, you and the Practitioner will engage in mediation with a qualified and mutually acceptable mediator. Legal action will only be pursued as a final option, and the party that prevails in such legal proceedings shall be eligible for reimbursement of all reasonable costs and fees.

Failure to Enforce

In the event that either party fails to enforce any provision of this Informed Consent, such failure shall not be construed as a waiver of the right to enforce said provision in the future. Any waiver of a breach or violation of any term or condition herein shall not constitute a waiver of any subsequent or similar breach or violation.

Severability

In the event that any term or portion of this Informed Consent is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of this Informed Consent shall remain in full force and effect to the fullest extent permitted by law. 

Governing Law

This Informed Consent shall be governed by and construed in accordance with the laws of the United States, and to the extent applicable, the laws of the state of New Mexico without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these Terms or the Services shall be conducted virtually, or at a mutually agreed upon physical location, and you hereby consent to the personal jurisdiction of such venue. In the event of any dispute or litigation arising from this contract, the prevailing party shall be entitled to recover their reasonable attorney's fees and costs from the non-prevailing party.

Entire Agreement

This Informed Consent, along with Kate Elliott Healing’s website Terms of Use, Disclaimer, and Privacy Policy, shall constitute the entire agreement between the parties. No amendment shall have effect unless made in writing and signed by both parties.
